Transgender Train Derails in Sixth Circuit

The Phyllis Schlafly Report
By John and Andy Schlafly

Republican legislatures in 20 states have banned the use of irreversible gender-changing procedures on children, overcoming the governor’s veto in five of those states with a sixth override likely. But in six of the 20 states, liberal federal judges blocked these good laws in response to lawsuits by liberal groups including the ACLU and Southern Poverty Law Center.

Now comes the first appellate decision, and it’s welcome news. On July 8, two of the finest appellate judges in the country, Jeffrey Sutton and the Trump-appointed Amul Thapar, delivered a setback to the transgender agenda by ruling to reinstate Tennessee’s new law against transgender operations on minor children.

The margin was 2-1 on the Sixth Circuit appellate court, with a Democrat-aligned judge dissenting. Appeals are still pending of bad district court decisions in Alabama, Arkansas, Florida, Indiana, and Kentucky, where beneficial state laws were blocked by federal judges.

Other states have refused to protect children from transgender operations, and this cultural battle is far from over. In California, a recall campaign rages against a few conservatives who were elected last year to a school board near Los Angeles.

The Centers for Disease Control and Prevention, considered the foremost health authority in our country until it mishandled the Covid pandemic, has come out entirely on the side of the transgender agenda. Recently the CDC’s website endorsed the ludicrous idea of “chestfeeding,” whereby transgender persons without breasts attempt to fake the production of breast milk with the use of dangerous drugs.

Politics is downwind from culture, and this past weekend the Netherlands crowned as the winner of its Miss Universe pageant a man competing as a trans woman. Sporting an elegant hairdo, this winning candidate had previously competed on the television show “Holland’s Next Top Model.”

The University of Cincinnati, ironically located in the same city where the Sixth Circuit presides, rescinded its reprimand of a teacher for flunking a student for using the term “biological woman.” Megan Rapinoe, the outspoken retiring player on the U.S. women’s soccer team, indicated she would welcome male-bodied trans women into that sport, even though her own women’s team was easily defeated by an under-15-years-old boys team.

The media and many judges are firmly on the side of the transgender movement, and they expect to win. A Clinton-appointed judge just ordered a public school to let a boy who identifies as a girl to use the girls’ bathroom, overriding a policy adopted by the elected school board in the town of Mukwonago, Wisconsin.

Law schools have fully embraced transgender follies, and unfortunately many courts will do likewise. The Supreme Court hires all of its law clerks from a handful of elite law schools, and those clerks perform the influential task of screening and describing cases before the Court either agrees to hear them or simply denies “cert” on a lower court decision.

The Supreme Court denied a recent application by West Virginia to reinstate its sensible law keeping boys out of girls sports, ducking this raging controversy just as the Court dodged all appeals about election fraud. For decades the Supreme Court accepted abortion cases only when the appeal was by the Left, and it will be interesting if Leftists appeal Judge Sutton’s decision against them.

Two years ago, Harvard Law School welcomed its “first transgender women of color” as teachers at the school. They joined two transgender men on the faculty, one of whom maintains a personal website that brags about “working with sex worker art collective that protested digital gentrification.”

Judge Sutton’s ruling is persuasive, and carries added weight due to his strong reputation as a “feeder” of clerks to the Supreme Court. Judge Sutton is notorious in some quarters for ruling against legal recognition of same-sex marriage in the case that was later overturned by the now-retired, left-leaning Justice Anthony Kennedy.

Tennessee’s new law, which was scheduled to go into effect on July 1st, prohibits “surgically removing, modifying, altering, or entering into tissues, cavities, or organs” of any person under the age of 18. It also bans “prescribing, administering, or dispensing any puberty blocker or hormone” to minor children.

The State plainly has authority, in truth a responsibility, to look after the health and safety of its children,” Judge Sutton wrote with the concurrence of Judge Thapar. “Tennessee could rationally take the side of caution before permitting irreversible medical treatments of its children,” they added.

The court found it unlikely that the Supreme Court would create a new constitutional right to transgender operations, when no such right has existed in the Constitution for 235 years. “Life-tenured federal judges should be wary of removing a vexing and novel topic of medical debate from the ebbs and flows of democracy,” the Sixth Circuit majority concluded as they reinstated the Tennessee law.

Independence Means Staying Out of Foreign Wars

The Phyllis Schlafly Report
By John and Andy Schlafly

America celebrates our independence on July 4th, and that includes freedom from never-ending foreign wars. Yet the globalists are trying to entrap us even further in the NATO war in Ukraine, where no end is in sight and the risk of it escalating into a nuclear disaster increases.

A record-breaking crowd of 50,000 in Pickens, South Carolina relentlessly booed Sen. Lindsey Graham (R-SC) when he took the stage at the Trump rally on Saturday. Graham is from the same rural county but is widely disliked now by ordinary Americans who oppose his pro-war positions.

Trump kept us out of foreign wars for four years and vows to end the war in Ukraine within 24 hours of becoming president again. But Biden and other presidential candidates are staunchly pro-war, and would even send American troops to fight Russia.

Too few Americans are enlisting in our Armed Services, which are not meeting recruitment goals. Beginning July 8, recruiters for the Navy will be required to work an additional day each week to try to enlist new recruits.

Last year the Army fell 25% below its recruiting goal. That was the Army’s worst recruiting year since our military draft ended in 1973.

Recruiting goals today are modest, not nearly enough to sustain a world war against Russia. The total military recruitment goal for 2022 was only 104,540 troops, out of our American population of 30 million aged 18 to 24, yet even that low goal cannot be met.

Presidential candidate Mike Pence, lacking in political support, made a surprise visit to Ukraine president Volodymyr Zelensky last month to pledge continued U.S. support for the war against Russia. On the same day Zelensky welcomed child climate change activist, Greta Thunberg, now 20 years old, to listen to her environmentalist agenda.

Pence declared on NBC News that “this is bigger than politics.” He then stated about Russia that “it wouldn’t be too long before they cross the border where our men and women would be required to fight.”

If Mike Pence is really open to the possibility that American “women would be required to fight” Russia, then he should not be trusted with the presidency. It sounds more like the feminists of the 1970s whose Equal Rights Amendment would have put women in combat alongside men.

Next week the nations belonging to NATO will meet in Vilnius, Lithuania, and President Biden has promised to attend. Locating this meeting near the border of Russia is provocative, as a way to try to confront Putin.

NATO, which is run by anti-American liberals, wants to add Sweden as its 32nd member, after Finland was accepted earlier this year. Any current member country can veto Sweden, however, and Turkey has threatened to withhold its consent.

Also atop the NATO agenda will be to demand an escalation of American entanglement in what has become a perpetual war in Ukraine. The United States will be asked to send advanced weaponry and to embark on a path of placing our troops in harm’s way.

“We need to be prepared that this offensive will be bloody and difficult,” NATO chief Lens Stoltenberg warned last month. But he was talking about Ukraine’s long-delayed offensive against Russia, using U.S. equipment.

Globalists at our Pentagon have already sent to Ukraine many hundreds of vehicles including Humvees and armored trucks. England has dangerously provided Ukraine with long-range missiles to be launched from military planes, in order to strike cities far inside of Russia, while Germany has sent advanced, highly destructive Leopard tanks.

This week the Wall Street Journal published an op-ed by Zelensky that pompously tried to explain to us the meaning of our Independence Day and, of course, encouraged more participation by the U.S. in the war there. While extolling democracy Zelensky somehow forgot to mention that he recently canceled parliamentary and presidential elections in his own country.

Zelensky wrote that “Ukrainians took to the streets in 2014 to oust the Russian-backed dictator,” but in fact that leader had been democratically elected. Zelensky has also outlawed the Orthodox Church in Ukraine, supposedly because its leaders are sympathetic to Russia.

Apparently only two things are slowing down the globalists who want to use the American military to control the world. First is the shortage of able-bodied volunteers who are willing to enlist today, for a variety of reasons that may include their own opposition to globalism.

Trump’s spectacular rally last weekend in South Carolina with the outpouring of an America First patriotism is the other obstacle to the globalists’ agenda. This grassroots uprising against further involvement in perpetual foreign wars, attempted by politicians of both parties in D.C. who are out-of-touch with the American public, can carry Trump to reelection.

Flood at the Border Sinks Biden

The Phyllis Schlafly Report
By John and Andy Schlafly

President Biden avoids and keeps far away from our nation’s wide-open southern border, where 200,000 people from all over the world crossed illegally last month and every month since Biden took office almost 30 months ago. But his chief Democrat rival, Robert F. Kennedy Jr., went to the border town of Yuma, Arizona on June 6, and had some choice words for Biden’s failed policy.

It was like a dystopian nightmare,” Kennedy said, “with all of these desperate people flooding across the wall, in a situation that clearly could have been prevented. People from all over the world, from Africa, from Uzbekistan, from Senegal, from Pakistan, Kazakhstan, Azerbaijan, Nepal, Tibet, India, Bangladesh, Peru, Colombia, we saw all of these people, these hundreds and hundreds of people coming across.

We’ve watched about 150 people come across in the last hour,” Kennedy continued. “Altogether, people have come across right here from 117 nations in the last couple of years. In 3 years, in total, 7 million people have come across the border illegally into our country.

And from here, they’re put on these buses, and they’re brought to the border patrol station where they’re processed. After four or five days, they’re released on their own recognizance into our country, and most of them are never seen or heard from again.”

Where did all these millions of foreigners go after they were turned loose by the Biden administration? A clue is provided by a shocking new study from the Center for Immigration Studies, which finds that students from immigrant-led households comprise 23% of public school enrollment nationwide, and in many regions the proportion is more than 65%.

Thousands of miles away, New Hampshire public schools are harmed by the immigration deluge. Next door in Massachusetts, the percentage of public students who are in immigrant households has jumped 13 to 28% in the last 30 years.

There should not be any illegal fentanyl in New Hampshire, but gangs profiting from drugs and human smuggling distribute that deadly drug to every state. Choking off that deadly traffic is preeminent on the minds of New Hampshire voters who will soon screen the presidential candidates of both parties.

This is not a good thing for our country,” Bobby Kennedy Jr. said after his first-hand, on-site inspection of the crisis at the border. “It is unsustainable.”

Liberals have been perplexed by how endless lawsuits and contrived indictments of Donald Trump have not slowed him down, or even made a dent in his popularity. The many reasons for Trump’s political invincibility include his unwavering commitment to America being for Americans, not foreigners.

Speaking in Columbus, Georgia, on June 10, Trump vowed that “I will immediately cancel every open-borders policy of the Biden Administration. I will use all necessary state, local, federal, and military resources to carry out the largest domestic deportation operation in American history.”

And to further deter illegal immigration,” Trump continued, “I will sign a Day One Executive Order ending automatic citizenship for children of illegal aliens.” Contrary to some uninformed pundits, the foolish policy of extending birthright citizenship to illegal aliens is not required by any law or court decision.

On Friday, the U.S. Supreme Court dropped the ball by declaring that they would not force President Biden to stop the illegal immigration that is overwhelming our states, institutions, and communities. With only Justice Alito dissenting, the Court ruled that the courts are powerless to order President Biden and his minions to obey the laws that require him to refuse entry, detain, and deport illegal migrants.

But then on Sunday, the people of Greece delivered the opposite verdict as they handed a landslide victory to the Trump-like candidate who has cracked down against illegal immigration there. His victory was by the largest margin in Greece in a half-century, and three new political parties even more conservative did well enough to win seats in its parliament.

Kyriakos Mitsotakis won by promising to extend a border fence to a region where many migrants are currently sneaking into Greece. A week earlier, voters in the traditionally liberal Finland elected what was described as “the most right-wing government ever ... taking a hard line on … immigration.”

The previously immigrant-welcoming countries of Denmark and Sweden have also shifted sharply to the right on this issue in recent years. Denmark’s current policies include imprisonment of illegal aliens with solitary confinement and seizure of assets, in order to deter migrants from entering that small country illegally.

The worldwide populist uprising against open borders is a harbinger of our own presidential election next year. On this issue, Biden is hopelessly out of touch with the American people, and he is sure to be defeated by Trump, unless the effective campaigning by RFKJr causes Biden to withdraw first.

Veto Rampage in Texas Discredits Anti-Trumpers

The Phyllis Schlafly Report
By John and Andy Schlafly

Texas Gov. Greg Abbott vetoed more than 75 bills before Sunday night’s deadline, mostly sponsored by conservative Texas state senators. Never before in the 178-year history of Texas has its governor vetoed so many bills passed by his own party.

Texas Republicans would override most of these vetoes if they could, but the legislature was required by the state constitution to adjourn in May until 2025. Tens of thousands of hours of work that went into all these bills were washed away by Abbott’s retaliatory strike against conservatives.

One of the bills that Gov. Abbott vetoed was SB 335, authored by conservative state Sen. Dr. Charles Schwertner (R-Georgetown). It passed the state senate by a unanimous vote of 31-0, and passed the state house by an overwhelming 119 to 19.

This bill sought to require the Texas Family and Protective Services Council, which makes recommendations to the notorious Department of Family and Protective Services, to post online videos of its meetings so that the public can see what they are doing at taxpayer expense. Yet Abbott vetoed this with a petulant message about an unrelated issue.

Another bill sponsored by one of the most conservative Texas legislators, Sen. Tan Parker (R-Flower Mound), would have authorized studying the conversion of coal-fired energy plants into cleaner nuclear plants. SB 1404 passed the senate unanimously 31-0 and passed the house nearly unanimously, yet was likewise vetoed by Abbott with the same peevishness.

Meanwhile, Abbott has refused to endorse Donald Trump for president despite using Trump’s endorsement of him to overcome a primary challenge to his reelection last year by two conservatives, former U.S. Rep. Allen West and state Sen. Don Huffines. Trump’s endorsement and a hoard of cash from wealthy donors enabled Abbott to survive his primary.

More than two-thirds of the oil and gas donations went to Abbott rather than all the other Texas Republican statewide candidates combined. There are no campaign contribution limits in Texas, so Abbott panders to multi-million-dollar donors from whom he has raised far more money than any other Texan in history.

Despite being reelected by Trump’s endorsement last year, Abbott’s refusal to endorse him now has the effect of limiting donations by these Texas mega-donors to Trump’s campaign and Trump-supporting PACs. A few anti-Trump billionaires and their egotistical mindset are making it easier for Joe Biden to win reelection next year.

Texas Lt. Gov. Dan Patrick, who leads the Texas Senate, prominently endorsed Trump earlier this year. That endorsement may not have sat well with the Never-Trump Republicans, including Abbott, and some view his veto rampage as a retaliation against Patrick.

Lt. Gov. Patrick pointed out that Abbott vetoed some bills as retaliation against conservative Texas Sen. Paul Bettencourt, who has been a leader in the effort to stop rampant election fraud in Harris County (Houston). “This is targeted vetoing of bills that have nothing to do with the issue at hand except Paul Bettencourt is the author of those bills,” Patrick said last Thursday in disgust.

Abbott has hurt the Republican Party in Texas with his dictator-like vetoes of many good bills based merely on who sponsored them. Even some Democrats criticize Abbott’s conduct, as State Sen. Sarah Eckhardt (D-Austin) observed about Abbott’s veto of her bipartisan bill, “This was NOT Vetoed on POLICY.”

Abbott’s retaliatory vetoes reflect how closely he is tied to RINO mega-donors frustrated by the lack of enactment of their preferred type of property tax reform. These RINO billionaires failed to provide needed financial support for Trump in 2020, and our country cannot afford a repeat of their treachery again next year.

While campaigning against Abbott more than a year ago, Allen West aired a campaign ad standing next to the unfinished border wall in Texas. West rhetorically wondered why Abbott has accomplished so little to secure the border, despite being governor for nearly a decade.

Our entire country suffers enormously from Abbott’s unwillingness and ineffectiveness about the Texas border with Mexico. Thousands pour over that Texas-Mexico border every day, bringing drugs with them that spread throughout our country.

Only a few good bills, such as the overwhelmingly popular ban on male-bodied transgenders invading women’s sports, and a ban on minors being subjected to life-altering transgender procedures, were signed into law by Gov. Abbott, who was not the real leader on either one. Nothing meaningful was supported or signed by Abbott to stem the tidal wave of illegal migrants crossing the Texas-Mexico border.

No Republican can win a future presidential election without winning Texas, yet Abbott is harming the GOP’s reputation with voters there by taking the party in the wrong direction. Governing for the benefit of a handful of oligarchs while retaliating against conservative legislators is a recipe for a long-term political disaster.

The Left’s war against parental rights

Ed Martin writes:
An ideological campaign has taken shape, from schools and statehouses to courtrooms and even in to the White House, to push parents out of fundamental decisions involving their children and thus to destroy parental rights.

The Biden Administration is leading the charge. President Joe Biden himself has said, “There is no such thing as someone else’s child. Our nation’s children are all our children.” Similar sentiments have been echoed by Vice President Harris who has referred to American children as “our children” and White House Press Secretary Karin Jean-Pierre, who has similarly said, “These are our kids. They belong to all of us.”

Deep State Declares War on Trump Voters

The Phyllis Schlafly Report
By John and Andy Schlafly

Until now, American voters have been allowed to select our next president without interference by federal prosecutors. In a free election the People can decide which issues are significant, such as entanglement in foreign wars, and which are petty, such as the location of some old papers from the previous administration.

But the federal workers who pursue political prosecutions of Trump and his supporters are as hostile to democracy as they are clueless about the loyalty of Trump voters. Special prosecutor Jack Smith, who disgracefully prosecuted Republican Gov. Bob McDonnell until Smith was reversed by the Supreme Court, now demands that Trump face a speedy trial, so that Smith’s office rather than the voters can decide the reelection of Trump.

Jack Smith’s unprecedented indictment will be heard by Judge Aileen Cannon, who had previously smacked down the feds after their excessive raid of Trump’s home at Mar-a-Lago last August. In that case she told the federal Trump-haters to back off, and she properly appointed a respected former judge to review the documents that were seized in the raid.

On appeal to a higher court, Judge Britt Grant, whose husband worked for nearly a decade for the Deep State at the CIA, showed improper rudeness to Trump’s attorney. Also on the panel was Judge Bill Pryor, who is often a rubber-stamp for prosecutors, and they reversed Judge Cannon’s fair ruling.

Yet now the liberal media, led by the New York Times, are complaining about the random assignment of the Trump indictment to Judge Cannon, despite her lack of any conflict of interest. What liberals dislike is her independence from politics, which is what a good judge should display.

Few Americans would base their vote on where President Trump stored boxes of documents relating to his presidency when he moved out of his residence at the White House. Many public officials take copies of documents with them when they leave office, as Joe Biden did when he left the White House in 2017 and Biden has not been charged with anything.

But many federal workers in D.C. are too virulently anti-Trump to allow the democratic process to work without interference by fanatical federal prosecutors. They have no employable skills outside of government and yet are bankrolled by an unlimited spigot of taxpayer dollars, which would have been shut off had the debt ceiling been enforced on June 1.

The timing of this federal indictment to be less than one week after suspension of the debt ceiling, which keeps the money flowing to them, seems to be more than a coincidence. The GOP majority in the House does not have to allow taxpayer millions to be spent on biased investigators taking pictures of boxes of obscure documents stored in an unused bathroom.

Trump has built successful companies and skyscrapers, employed thousands, and defeated the idol of most federal workers: Hillary Clinton. Then Trump committed unforgivable sins in the eyes of the feds by firing their FBI director, James Comey, and by pardoning the victims of Department of Justice political prosecutions, including Lt. Gen. Michael Flynn.

The January 6 protests were, on top of all that, a thorough humiliation of the Deep State in D.C. for which it has been retaliating ever since. All Trump did on that day was to give a speech while serving as president, and it is very difficult to convert a presidential address into some kind of crime.

So Trump-haters hatched this plan to accuse this former and future president of “willful retention” of his own presidential papers, abusing a century-old law that has never before been used in this way. The federal bullies also indicted a U.S. Navy veteran from Guam who has been a personal assistant to Trump, Walt Nauta, over the phony separate crime of supposedly lying to the FBI as Nauta voluntarily described his service to the former president.

Local prosecutors who prosecute real crimes do not regard lying to authorities as a separate crime, yet that is the federal prosecutors’ favorite fake crime to invoke. They used it improperly against Lt. Gen. Michael Flynn, in what was later discovered to have been a premeditated ambush by the FBI, and threatened the respected author Dr. Jerome Corsi with this until he publicized the injustice.

Senate Majority leader Chuck Schumer, a Democrat from New York, famously warned Trump that the intelligence community, also known as the Deep State, has “six ways from Sunday at getting back at you.” Just before Trump was inaugurated to his first term, Schumer said on national television that “from what I am told, they are very upset with how he has talked about them.”

This new indictment proves how vindictively the Deep State will retaliate. It needs to be defunded.

Ambush Impeachment in Texas Stole from Voters

The Phyllis Schlafly Report
By John and Andy Schlafly

The ambush impeachment and removal of Texas Attorney General Ken Paxton was a shocking and undemocratic assault on the will of the voters. Paxton won reelection by 800,000 votes last November, yet merely one legislative chamber was able to override those votes with a scheme hatched in secret and sprung as a last-minute surprise.
Imagine if Congress could force the removal of a president by secretly plotting an impeachment, suddenly executed a few days later without a single public hearing. The American people would not stand for what the New York Times called “unexpected — as of a week ago there was little public indication that an impeachment could be imminent.”
Who really plotted this unprecedented theft from voters remains a closely guarded secret. Donald Trump led the way by
truthing his opposition: “Hopefully Republicans in the Texas House will agree that this is a very unfair process that should not be allowed to happen or proceed—I will fight you if it does.”
Texas House Speaker Dade Phelan, who was elected by pandering to Democrats, “
kept this under wraps until the end, there wasn’t a lot of time for Paxton’s defenders to react,” observes Rice University political scientist Mark Jones. It was obviously improper to deprive the voters of an elected official without first informing the public and hearing from them.
As pointed out during the brief debate on the Texas House floor, there was no justification for concealing the plot to remove Paxton from office until shortly prior to the vote. Paxton has been the leader in
litigating against open borders and other unlawful policies of the Biden administration, and two months ago he opened an official investigation of Pfizer over its Covid-19 vaccine.
“For the last nine years, Ken has been the strongest conservative AG in the country. Bar none,” Sen. Ted Cruz (R-TX) stated in opposition to the ambush impeachment of Paxton. Texas Republican Party Chairman Matt Rinaldi strongly defended Paxton and described the proceeding as a “sham” that was “led by a liberal speaker trying to undermine his conservative adversaries.”
A total of 23 Republicans courageously voted against removing Paxton, while none of the Democrats did although some criticized it. The most senior Democrat in the House, the African American Harold Dutton, Jr., eloquently spoke against how improper the impeachment was.
On TruthSocial Trump exclaimed to thunderous support by tens of thousands, “MISSING IN ACTION! Where is the Governor of Texas on his Attorney General’s impeachment?”
The silent Republicans share something in common. In addition to Abbott’s shamefully going AWOL, Trump’s presidential rivals have likewise been silent, as has the senior U.S. Senator from Texas, John Cornyn.
All these Republicans depend on heavy
support by dark money mega-donors, who are mostly globalist billionaires seeking their own self-serving agenda that includes an open border. DeSantis, Tim Scott, Nikki Haley, and wannabe Senate Majority Leader John Cornyn all depend on millions from this network to fuel their political ambitions.
Most of the 60 Texas Republicans who voted for Paxton’s removal probably feared retaliation by the
dark money globalists, as there are no campaign donation limits in Texas. Gov. Abbott himself has been a frequent attendee to the Koch network donor confabs, whose members funnel money to those who back their agenda and try to punish those who get in their way.
The influence of globalist mega-donors is also reflected in how Texas Republicans enacted the Convention of States resolution to seek a new convention under Article V to change the U.S. Constitution. When the late Justice Scalia was asked in 2015 about the desirability of holding a new constitutional convention, he called it
a “horrible idea.”
Yet to appease his ego-driven donors,
Texas Gov. Abbott made the Convention of States one of his highest legislative priorities in 2017, ahead of border security and other more important issues. Republican legislators who would ordinarily oppose this were then bullied to vote for it, but on the condition it would expire in eight years.
Conservatives in ten other states have defeated this “horrible idea” of a
Convention of States this year. Yet the dark money backing this deceptive attempt to change our Constitution insisted on tacking another 8-year extension to the 2017 Texas application to Congress for a convention.
Every Republican in the Texas legislature then voted this spring for a new 8-year extension on this horrible idea. These were not sincere votes, but rather the product of a campaign funding system driven by large donors.

The good news is that a Democrat state representative raised a point of order against the 8-year extension of the Convention of States, so it died when the Texas legislature adjourned on Monday. The other good news is the upcoming impeachment trial in the Texas Senate should flush out the dark money puppets seeking to overturn the election of Paxton.

Biden to let Boys Play on Girls Sports Teams

The Biden administration published proposed regulations of sex discrimination in school sports, and I submitted this comment:
The proposal refers to "harm" 53 times, but never identifies the harm accurately. It is considered beneficial to have all-girls sports teams. If that is true, then allowing a boy on a girls team harms every girl on the team, every girl who is displaced, and every girl on opposition teams. The boy with gender disphoria who may identify as a girl is probably harmed as well, as the team would be catering to a dangerous delusion.

Sex is binary in humans. That is a scientific fact. Furthermore, our social order has depended on male-female distinctions for millennia. Attempts to upset that social order are based on an extremist political ideology, and not on popular opinion, law, or benefit to children. The proposed regulations should be rejected.

Here is an interview of a feminist bicycle racing champion who is unhappy about men taking over women's cycling.

GOP Should Demand End to Biden’s Open Border

The Phyllis Schlafly Report
By John and Andy Schlafly

By a stunning 20-point margin, the conservative New Democracy Party in Greece prevailed in its national election on Sunday. For decades socialists had badly governed that ancient birthplace of democracy, running up immense debt and causing other problems which the conservative leadership has since overcome.

This landslide surpassed the polling predictions, and is being described as a political earthquake. The reason for this triumph is clear: the conservative party there took a tough stance against migration, which is the opposite of what Biden is doing here.

On the eve of this election a video went viral purporting to show mistreatment of migrants, many of whom sneak in by sea. Supposedly the conservative candidate, currently its prime minister, was allowing the placement of migrants on rafts and then abandoning them in the middle of the Aegean Sea.

That video did not hurt Prime Minister Kyriakos Mitsotakis with voters. “We protected our country’s borders both on land and at sea, and reduced irregular arrivals by 90 percent,” he said at a recent campaign rally until he was drowned out by applause.

Greece was getting 10,000 migrants a month from Turkey, while Biden is allowing many times that number to enter the U.S. from Mexico. The Republican Party should take a stronger stance against this than it has, and the Greek election shows where voters are on this issue.

House Speaker Kevin McCarthy (R-CA) should be telling Biden that there will be no deal on increasing the debt ceiling until Biden closes the southern border to illegal immigration. Texas Governor Greg Abbott should demand action by the Texas legislature before it adjourns on May 29, or else force them to return in a special session.

All of Europe has quietly reversed its pro-immigrant policy of five years ago, and now the European Union seems fine with countries closing their borders. In other words, political leaders in Europe have come around to agree with the position first espoused by Donald Trump, despite snickering against him while he was president.

Yet Republicans remain slow on this issue. It has not been a priority in the legislative session in Texas, which along with Arizona receives the largest hordes of illegals pouring into our country. Drugs come in with them, and make their way into schools and communities thousands of miles into the interior of our country.

Last week 11,000 migrants were deported after crossing our border illegally, while another 21,000 were released to await a court appearance scheduled in the distant future. Most of those migrants will never show up in court, but instead will travel to another unsuspecting American community, and if arrested there authorities will typically release them again.

Biden is not going to overcome illegal immigration this way, and probably does not want to. Many Democrats see the migrants as future voters for their party, while the globalists backing both Biden and rivals to Trump see migrants as providing cheaper labor and thus bigger profits for the globalists’ private equity investment funds.

Illegal aliens sleeping in the streets in El Paso, Texas, were being urged to turn themselves in to begin the processing for citizenship. Biden terminated President Trump’s secure border policy known as “Remain in Mexico” and then allowed Trump’s Title 42 policy to expire earlier this month.

Hours before Title 42 was set to expire, a federal judge appointed by Trump in Florida slapped Biden with an injunction against opening the floodgates now. “The Southwest Border has been out of control for the past 2 years,” Judge T. Kent Wetherell said in his court order against Biden’s open border policy.

Biden had planned to release thousands of newly arriving illegal aliens on “parole” into this country, while supposedly evaluating their applications for asylum. But as Americans painfully learned during crime waves in this country, the public is not protected against violence when criminals are out on parole rather than deported or locked up.

On CBS Face the Nation on Sunday, Miami’s Republican Mayor Francis Suarez criticized the new immigration laws signed by Gov. Ron DeSantis (R-FL) as "headline grabbers." The billionaire globalists funding DeSantis’s campaign, and the campaigns of other opponents of Trump, see greater profits in more illegal aliens as they work for lower wages.

Meanwhile in Texas, its Republican Gov. Abbott sent a busload of illegal aliens to Denver, which is the fifth Democrat-run city that has received busloads of migrants from Texas. As Title 42 was expiring, Gov. Abbott even bused some to Vice President Kamala Harris’s residence.

While that is good theater, it does not explain the lack of progress by Gov. Abbott in securing the Texas border. Abbott has failed to endorse Trump and failed to strengthen border security in Texas, because many Never-Trump Republican mega-donors actually support Biden’s open borders.

The Leftist War on Self-Defense

The Phyllis Schlafly Report
By John and Andy Schlafly

The prosecution of an unarmed former Marine for acting in self-defense to protect passengers on the New York City subway has sparked a nationwide uproar. This latest salvo in the Leftist war on self-defense has liberals demanding additional charges against the hero.

Daniel Penny, only 24 years old, is a white ex-Marine sergeant from Long Island who wrestled down and restrained a troubled black man, Jordan Neely. With no police officers in sight, Neely was menacing multiple passengers on the moving subway train until Penny restrained Neely while asking others to call the police.

The dramatic rescue by a quick-thinking civilian is reminiscent of other recent episodes in which an ordinary citizen stepped up to save others from harm. The bystander who averted a massacre at an Indiana shopping mall last year, 22-year-old Elisjsha Dicken, was hailed as a hero then, as Daniel Penny should be applauded now.

Other passengers on the subway also viewed Neely as dangerous, and helped restrain him. Penny deserves the praise he’s receiving nationwide for acting in self-defense, and $2.5 million from 50,000 donors has already poured in to support his legal defense.

We don’t know yet what legal or illegal drugs may have triggered frightening behavior by Neely, who has a long criminal record that included punching a 67-year-old woman in the face and breaking her nose less than two years ago. A toxicology report would ordinarily be necessary before declaring a cause of death, but the New York City medical examiner is a political appointee of its Democrat mayor.

The police who were called to the scene saw no reason to arrest Daniel Penny, and no charges were initially brought even after Neely was declared dead at a hospital. Self-defense and protecting others has never been a crime, and should not become one now.

But after days of street protests demanding that Penny be prosecuted for murder, the New York City medical examiner announced that Neely’s death was a homicide caused by “compression of neck (chokehold).” District Attorney Alvin Bragg, famous for his political indictment of Trump over non-crimes, mollified the Leftist protesters by charging Daniel Penny with manslaughter.

The failure of both Bragg and the medical examiner to await the results of the toxicology report proves that politics, not medical science, is the driving force behind the manslaughter charge. It is reminiscent of the George Floyd case, with Penny being made a scapegoat just as the bystander officers in that case were.

The fake medical science in the first jury trial in the Floyd case included a prosecution witness who bizarrely invited jurors to grab their own necks, as though that would prove anything scientific about the cause of death in a criminal suspect who was intoxicated by an illegal drug. Imagine a similar stunt if Penny goes on trial in a hostile venue in New York City.

There are 100,000 unexpected deaths caused annually by illegal drugs in the United States, which is more than double the number of gun homicides. Inevitably, some drug-related deaths will occur while an erratic intoxicated person is being restrained.

When the Leftist mob calls Daniel Penny a vigilante instead of a Good Samaritan, it undermines the rule of law necessary to attain justice. If there is a rush to prejudge or find a scapegoat every time someone on drugs dies while being restrained, then self-defense will no longer be safely available to anyone.

There has been an outpouring of support for this hero, but the jury pool in New York City is not representative of the rest of our country. The District Attorney’s office has far more resources than Penny can possibly raise, while protesters are still demanding that the charges against him be upgraded to include murder.

Despite the partisan divide over this case, one New York Democrat has publicly defended the subway hero. Former Governor David Paterson said on Sunday that Penny “did something because he saw danger for other people and tried to prevent it. He did not meet the threshold where you charge someone.”

Paterson suggested that District Attorney Alvin Bragg, a fellow African-American, may have charged Penny merely because other minorities have died under similar circumstances in the past. During his single term as governor, Paterson often used his pardon power to correct injustices.

An Army sergeant convicted of killing an armed Black Lives Matter protester in Austin, despite asserting that it was in self-defense, just received a harsh sentence of 25 years in prison. Penny could be imprisoned for 15 years if convicted of manslaughter, but reasonable self-defense should not face such punishment.

Donald Trump observes that Penny ”was in great danger and the other people in the car were in great danger.” There should not be a prosecution of an unarmed Good Samaritan who acts quickly to defend others.

21 States Stand Against Militant Transgenders

The Phyllis Schlafly Report
By John and Andy Schlafly

Twenty-one states (and counting) stand against the transgender tidal wave by enacting legislation to protect families, vulnerable children, girls’ sports, and the right not to use a transgender pronoun. A new Tennessee law clarifies “sex” as “a person's immutable biological sex as determined by anatomy and genetics existing at the time of birth.”

Pro-transgender marketing for Bud Light beer backfired badly on the Belgian-based beer giant AB InBev. Sales for Bud Light decreased by 21% for the week ending on April 22, a third consecutive weekly decline following the company’s disastrous attempt to reposition that iconic product by insulting its traditional customer base.

President Biden’s poll numbers have also dropped sharply, to a new low of 36% from 42% only three months ago, while he pushes the unpopular transgender agenda. Biden has only 26% approval among the essential voting demographic of voters under 30.

The next three weeks will mark the climax of the biennial Texas legislature, which must adjourn by law on May 29. Militant transgender protesters and parliamentary delay tactics by their allies in the Texas state house twice blocked a key vote last week on a good bill protecting against harmful transgender child treatments, which had already passed the state senate.

While the mostly peaceful Trump supporters who entered the U.S. Capitol on January 6, 2021 received stiff prison sentences as long as 14 years, favorable publicity showers the transgender militants who disrupted the Texas Capitol. Charges have even been dropped against one transgender protester accused of assaulting an officer there, in sharp contrast with the over prosecution of Trump supporters in D.C.

The transgender activists in Texas were interfering with a vote on SB 14, which would ban the use of puberty blockers and hormone therapy in children. Similar laws protecting children from irreversible treatments and mutilation have passed in 16 states, while 8 states have prohibited persons from using bathrooms of the opposite sex.

But 10 states are moving in the opposite direction, having enacted laws to promote the transgender agenda, even requiring conscientious physicians to provide medical interventions that violate traditional ethical principles. The militant transgenders have enormous financial and political backing as they try to enact their agenda nationwide.

Detransitioners, those who regret being victimized by transgender treatments or operations as children, are suing for the harm inflicted on them. One such lawsuit is against Kaiser Permanente for putting a 13-year-old girl on puberty blockers and testosterone, and then performing a double mastectomy at age 15, who by age 16 wanted to restore her life as a girl.

Despite the many lives being wrecked by transgender medications, the media show us confused kids who want transgender operations or seek to play on a sports team of the opposite sex. Armed with free attorney services from liberal entities, new lawsuits challenge state laws protecting girls’ bathrooms and sports.

Unfortunately, courts are likely to block some of these good state laws, as law schools keep turning out pro-transgender attorneys. The U.S. Supreme Court signaled its unwillingness to defend state laws that protect girls’ sports, when last month it denied a petition from West Virginia to reinstate its law.

Also stalled in the Texas House is a bill to protect women’s college sports, SB 15. The obstacle there appears to be opposition by the pro-transgender NCAA, which insists on using only testosterone tests as a way to pretend to protect women’s sports.

Testosterone tests are inadequate because even if the male hormone is artificially reduced, men still inherently have immense physical advantages over female athletes. For example, the average male is 5 inches taller than the average female, which gives men a decisive margin in many sports including swimming and track and field events.

The average height of players in women’s professional basketball is only 6 feet, while the corresponding average for a man in the NBA is 6 feet 6 inches. Leveling testosterone will not even out that disparity, or other sex differences such as how males are much less vulnerable to sports injuries than women and girls.

Last week a transgender athlete won a women’s cycling event recognized by the world cycling authority. While some international sports authorities are belatedly beginning to change their rules, the top American sports leagues beholden to television contracts with the liberal media are not budging.

Democrat Presidential candidate Robert F. Kennedy, Jr. sides with girls, women, and Trump against allowing males to compete in female sports. But Biden recently issued Title IX regulations that will be used by liberal courts to invalidate state laws protecting girls’ sports against the transgender invasion.

Biden supports extremism in the transgender movement, which is where the media wants him to be. With rock-bottom approval ratings, Biden cannot win renomination without continued backing by the pro-transgender media.
